Progressive-Think

An attorney trying to form a defense team for the surviving Somali pirate made this statement:

"I think there's a grave question as to whether America was in violation of principles of truce in warfare on the high seas," said Kuby. "This man seemed to come on to the Bainbridge under a flag of truce to negotiate. He was then captured. There is a question whether he is lawfully in American custody and serious questions as to whether he can be prosecuted because of his age."

My head almost exploded.
These guys throw a grappling hook over the gunwale of the Maersk-Alabama, and while being doused with the only means the crew has to resist them... a firehose, hoist their AK-47 laden bodies up the rope and onto the deck. In what parallel universe can anyone consider these pirates were wanting to
"negotiate under a flag of truce"?

This is a nightmare.
Someone wake me please.

That is a lawyer doing the worst thing a lawyer can do (and that's saying something), fighting his case in the media.

I'm sure there is a prosecutor just itching to ask him which was the international symbol for truce, the grappling hook or the assault rifle?

I would like to volunteer my services to be the Somali's lawyer - I believe a "twinkie defense" would work well here.

"Your Honor, my client is a Twinkie. String him up."

This lawyer is absolutely correct. Under the laws of truce on the sea the captain of the Bainbridge should have released him.

Given however, that the only other boat nearby was a hijacked American lifeboat whose rightful owner was also on the Bainbridge and which would have to have been confiscated the Captains only real choice would have been to give the criminal a lifejacket, an MRE, a bottle of Evian and toss his ass over the side.

He could have argued that it was the only legal move.

Wait...

Didn't the Alabama crew negotiate to return one of the pirates to his friends in exchange for the release of the captain? What about THAT little bit of negotiating under a flag of truce?

Oh, wait. I keep forgetting. The US is the only player that is expected to play by the rules.

I just read a report and letter from the Navy Seal team and the reason why this went for 4 days.
You guessed it, our lusterous Prez wouldn't let them do their job.

Since when should it even be a debate that a person and or company cannot protect what is lawfully theirs. I am sorry, that group is deadmeat. If the same thing had happened in your home, the debate would be moot.

This world is going down the wrong path of pandering to all these wrong doers. I am sick that our government is giving out sensitive info to the world of terrorist and making us sitting ducks.

I will bet the next person, that in one year, we won't even recognize the USA as it stands now, or did a few months ago.

Is it just me, or am I the only one seeing a pattern here? I truly feel there is a underlying plot going on, that will rock us to our cores. I pray that I am so very wrong.
