Some years ago, George Harrison was sued because the first three notes of "My Sweet Lord" were similar to "The Chiffon's" "He's so fine".
Harrison lost that suit and had to pay. I thought it was ridiculous.

I know that some get away with it because of the ubiquity of the particular chord structure they use, but I'm not sure exactly where the line is.
